Our firm has represented both Landlords and Tenants in drafting leases and litigation including evictions and suits to recover rent. New Jersey is a very progressive State in enacting legislation to protect tenant’s rights. It is critical for both Landlords and Tenants to be aware of the current law and their legal rights which sometimes have harsh results for landlords and sometimes tenants. One basic principal of New Jersey landlord tenant law is that in most residential tenancies a landlord does not have the right to evict simply because the lease has expired even if there is no lease. This can cause significant problems for Landlords and provide significant protections to Tenants. Only an attorney can advise you on what your particular rights are in any given landlord-tenant relationship. It is therefore important to consult with an attorney before you enter into any lease agreement or prior to entering into any litigation concerning your existing lease.
